Fundamental Dishonesty in Clinical Negligence Claims

SYMLS are pleased to welcome Mr Richard Norton, who is Joint Head of Chambers at St Johns Buildilgs. Mr Norton handles a large range of clinical negligence cases including delayed diagnosis of cancer and surgical negligence claims.

Section 57 of the Criminal Justice and Courts Act 2015 provides that: where the Court finds that the Claimant isentitled to damages in respect of the claim, but, on application by the Defendant, the Court is satisfied that the Clainant has been fundamentally dishonest in relation to the primary claim,or related claim;the Court must dismiss the primary clain, unless it is satisfied that the claimant would suffer substantialinjustice if the claimwere dismissed.

Mr Norton will explain this principle, in view of a notableincrease in applications being seen during Cl nical Negligence Claims. He will provide examples where the Court has offered guidance in refining both the definition and the threshold for successful appl cation.
